Do Your Website's 'Terms of Use' Mean Anything?

Most website managers create terms of use before the site goes live. These terms describe what the site owner expects from users and what users can expect from the website. Courts will enforce online terms and conditions against consumer users, provided they have adequate notice and an opportunity for review. Clickwrap vs. browsewrap terms may not hold up in court as a binding legal contract. Prohibit automated and excessive queries against bots, crawlers, cookies, or any other intrusive scraping device. Make clear what type of access is acceptable, and the amount of information that can be accessed.
