OVERVIEW: A BRAVE NEW WORLD OF SOFTWARE PIRACY Plaintiffs and Class members are owners of copyright interests in materials made available publicly on GitHub that are subject to various licenses containing conditions for use of those works (the “Licensed Materials”). All the licenses at issue here (the “Licenses”) contain certain common terms (the “License Terms”). “Artificial Intelligence” is referred to herein as “AI.” AI is defined for the purposes of this Complaint as a computer program that algorithmically simulates human reasoning or inference, often using statistical methods. Machine Learning (“ML”) is a subset of AI in which the behavior of the program is derived from studying a corpus of material called training data. GitHub is a company founded in 2008 by a team of open-source enthusiasts. At the time, GitHub’s stated goal was to support open-source development, especially by hosting open-source source code on the website . Over the next 10 years, GitHub, based on these representations succeeded wildly, attracting nearly 25 million developers. github.com Developers published Licensed Materials on GitHub pursuant to written Licenses. In particular, the most popular ones share a common term: use of the Licensed Materials requires some form of attribution, usually by, among other things, including a copy of the license along with the name and copyright notice of the original author. On October 26, 2018, Microsoft acquired GitHub for $7.5 billion. Though some members of the open-source community were skeptical of this union, Microsoft repeated one mantra throughout: “Microsoft Loves Open Source.” For the first few years, Microsoft’s representations seemed credible. Microsoft invested $1 billion in OpenAI LP in July 2019 at a $20 billion valuation. In 2020, Microsoft became exclusive licensee of OpenAI’s GPT-3 language model—despite OpenAI’s continued claims its products are meant to benefit “humanity” at large. In 2021, Microsoft began offering GPT-3 through its Azure cloud-computing platform. On October 20, 2022, it was reported that OpenAI “is in advanced talks to raise more funding from Microsoft” at that same $20 billion valuation. Copilot runs on Microsoft’s Azure platform. Microsoft has used Copilot to promote Azure’s processing power, particularly regarding AI. On information and belief, Microsoft obtained a partial ownership interest in OpenAI in exchange for its $1 billion investment. As OpenAI’s largest investor and largest service provider—specifically in connection with Microsoft’s Azure product—Microsoft exerts considerable control over OpenAI. In June 2021, GitHub and OpenAI launched Copilot, an AI-based product that promises to assist software coders by providing or filling in blocks of code using AI. GitHub charges Copilot users $10 per month or $100 per year for this service. Copilot ignores, violates, and removes the Licenses offered by thousands—possibly millions—of software developers, thereby accomplishing software piracy on an unprecedented scale. Copilot outputs text derived from Plaintiffs’ and the Class’s Licensed Materials without adhering to the applicable License Terms and applicable laws. Copilot’s output is referred herein as “Output.” On August 10, 2021, OpenAI debuted its Codex product, which converts natural language into code and is integrated into Copilot. Copilot and Codex can be called either AIs or MLs. Codex and Copilot will be referred to as Ais herein unless a distinction is required. Though Defendants have been cagey about what data was used to train the AI,[2] they have conceded that the training data includes data in vast numbers of publicly accessible repositories on GitHub,[3] which include and are limited by Licenses. Among other things, Defendants stripped Plaintiffs’ and the Class’s attribution, copyright notice, and license terms from their code in violation of the Licenses and Plaintiffs’ and the Class’s rights. Defendants used Copilot to distribute the now-anonymized code to Copilot users as if it were created by Copilot. Copilot is run entirely on Microsoft’s Azure cloud-computing platform. Copilot often simply reproduces code that can be traced back to open-source repositories or open-source licensees. Contrary to and in violation of the Licenses, code reproduced by Copilot never includes attributions to the underlying authors. GitHub and OpenAI have offered shifting accounts of the source and amount of the code or other data used to train and operate Copilot. They have also offered shifting justifications for why a commercial AI product like Copilot should be exempt from these license requirements, often citing “fair use.” It is not fair, permitted, or justified. On the contrary, Copilot’s goal is to replace a huge swath of open source by taking it and keeping it inside a GitHub-controlled paywall. It violates the licenses that open-source programmers chose and monetizes their code despite GitHub’s pledge never to do so. We all get a feeling that we don’t meet the requirements of modern life. The state of the modern world is usually described with the VUCA term. I will briefly recall it below for better understanding of the new BANI world. — steady, predictable, ordinary, and definite. The period of SPOD influence ended in the 1980s due to the rapid development of technology and the increase in the data amount. The VUCA stage replaced the SPOD world The term “VUCA” appeared in 1987 and was used as a definition of a constantly changing world where you had to study and process huge amounts of information as well as quickly respond to new facts. In workflows, it looks like this: gives impetus to unpredictable transformations and the appearance of twofold situations: not only in everyday life but also in business. It’s not clear how long this state can last, and how to conduct business in conditions of such rapidly changing circumstances. Volatility (V) doesn’t provide the possibility for planning further actions due to the lack of necessary information. It’s impossible to predict the effectiveness of development and introduction of new products to the market. Ambiguity (A) In the VUCA environment, it’s already difficult to manage companies aimed at gradual growth and development. You should be able to think strategically, find ways out of crisis situations, make and implement decisions quickly, and take thoughtful risks. As soon as it started to seem that businesses began to get used to this, the pandemic and the war in Ukraine have shown that chaos can come to us even faster. Describing the state of the modern world, we can call it borderline with almost no landmarks left. To name it, the futurist Jamais Cascio, by analogy with the previous ones, has offered to use a new abbreviated term — BANI. BANI is a faster and more complex chaotic world with no clear structure. In comparison to it, the volatile VUCA world literally looks like the center of calm and order. There is an interesting esoteric parallel between the worlds of and the transition of mankind from the age of Kali-yuga to the New Age. Right now the world is on the border between these two periods, and it brings a certain tension as the scriptures say. SPOD-VUCA-BANI Futurologists, on the other hand, believe that we are at the beginning of a period where centuries of artificial intelligence development, robots, and synthetic food await us. It is predicted that there will be technologies and devices which will allow comfort life, but ... for a small part of Earth's population, leaving most of the people poor. Eventually, it can lead to the disappearance of all life if we don’t reconsider our approaches and values. However, everyone agrees that the current stage can be referred to as “borderline”. It’s a time when people have to survive while making tremendous efforts due to changes in so many aspects simultaneously as well as due to the lack of psycho-emotional support. The absorption of minds by imposed stereotypes, the rise of bad habits, the shift in spiritual values, the preoccupation with material problems, the lack of happiness within oneself, and the excessive external orientation are the distinguishing features of this period. What Is BANI? If you look closely, you realize that the scriptures are mainly right in describing such periods as extremely gloomy. Fortunately, there is also a bright side. Those, who aren’t afraid of forthcoming changes, who can prioritize the material and the spiritual (both are important), who can be morally stable, get a chance to live a healthy fulfilling life. Now the results of thoughts and actions return to people much faster than ever. Karma, or the law of cause and effect, works instantly! You can go through inner transformation and change yourself. Seize the opportunity to achieve success, get spiritual growth, and smooth out the negative consequences of past wrong deeds. Anyway, it will be useful! So, what does the BANI world have to do with it? Let's look at it closely and take it as a guide for individual transformation. After all, I don’t want to write another “horror story” article, because there are enough of them on the Internet, or tell how COVID-19 and the war in Ukraine have messed up the intended prospects. 2019 and 2022 made it absolutely clear that you always need to know how to act in the world of constantly changing external circumstances, restless thoughts, and uncertainty about the future. That’s what we'll talk about today. What the BANI abbreviation means and what it stands for: Our habitual ways of action and methods can collapse at any moment. No one is protected, there is no reliable support, and any little thing can shake the established order. Brittle (B). This world keeps everyone in a state of anxiety. It’s unknown where you will be tomorrow, what will happen soon, and what opportunities will be lost. Anxious (A). There is no clear link between cause and effect. An event can affect a future goal in the most unexpected way. To achieve the result, you have to take numerous multidirectional actions. Nonlinear (N). There is a lack of knowledge and data; decisions are made by touch. It’s impossible to form a clear picture of events happening around you. Incomprehensible (I). Reorientation is a reality today, and we can’t leave it aside. We want transformations, but we are extremely afraid of changes and events we can’t explain. Experts, who study the psychology of modern people, recommend some rules for those who want to reduce the stress effect: Treat the changes in the world as new opportunities, don’t delay your development. The feeling of anxiety has always been with people. Train your stamina, become stronger while facing chaos, toughen up and learn to benefit from failure. There is no point in long-term strategies when everything changes so quickly. Move forward step by step, be attentive, and take proactive steps whenever possible. Establish the most comfortable horizons. For me, for example, it’s 1 day, you may have 1 hour. Make a plan for a given time, and as soon as you finish it, you’ll get motivation for the next achievements. Be prepared for any eventuality; be flexible and creative while making decisions. Learn from mistakes, make adjustments, and test new methods that can help you become better. Don't wait for the perfect moment! Try to understand the essence of what happens — put aside everything that is unnecessary. Trust your intuition and experience. Often instant decisions can be more accurate than carefully considered ones. Don't worry if everything seems to be turned upside down. How do you know that the strategy you are used to is better than the new one? And the most important thing — master new competencies! According to experts, by 2030 due to the technology development, there will be about 375 million people in the world who will have to change their professions or become unemployed! Hundreds of professions will disappear or lead people’s careers to a dead end: ushers, quantity surveyors, bank managers, cashiers, dispatchers, economists, secretaries, call center operators, etc. They will lose their jobs unless they change their specialization. It’s well-known that people use the knowledge which can be applied in practice. Traditional higher education doesn’t usually provide students with practical skills and necessary training that could help to get a good job. Our changing world turns lifelong learning into a particular value. Thanks to a continuous process of learning, it’s much easier to adapt to changes in the labor market. What Skills Will Be Important, What Knowledge Should Be Acquired and What Illusions Should Be Abandoned in the New BANI World? A permanent stable job isn’t something to rely on these days. The main task is the ability to adapt and let new skills as well as new people into your life. If you don't see any opportunities for professional and personal growth at your workplace, then change it. Or simultaneously start blogging, consulting, and creating a personal brand in the information space. The important moment: gaining new knowledge at lectures and courses should influence your behavior as well as help you to view the world in a different way. What Is The New World Order And One World Government? The terms “New World Order”, “One World Government”, and “Great Reset” are more or less interchangeable. You don’t need a PHD in political theory; it means greater control and domination for those in charge. What we have got, except even worse. It’s the difference between the super centralized internet and the decentralized internet. Conceivably, we will have a global currency with everything tracked and monitored, with all transactions linked on a blockchain and tied to location. Any contrary ideas can result in a suspension of your finances. And there won’t be any independent media to complain to. The (True) New World Order is already being built on the decentralized internet of distributed ledgers. And you and I are the ones who are both users controllers. and The farce that we have all been witnessing on television paints a certain picture, but innovations within Web3 portray quite another. We are building our own financial system, our own governance systems, our own education systems, and our own media systems. All without compromising on the personal information of users. It’s all optional and transparent. The penny has not yet dropped for most people, but we are literally building a new planet, and the ongoing scandals are necessary to push more people towards blockchain and the decentralized internet. People don’t move unless pushed; that's a sad but accurate fact of human existence. The Orwellian New World Order takes its power from a centralized internet. The True New World order takes its power from the decentralized internet. For members of the crypto community, the metaverse is not a new concept. It's a logical extension of our increasingly digital lives and something the world's been moving toward for some time now. Here's a bit about our project and why we think it's such an excellent expression of what the metaverse can be. ArtMeta A Fully-Realized Digital World To create a metaverse fit to house fine art, we thought it was important to design an environment that evoked many of the art styles that would appear within it. So, we've decided to create a metaverse based on an imaginary city on an island all its own. The city itself is the brainchild of painter Jonathan Delachaux, and executed with the help of Romain Donnot — a DI specialist, and digital/visual effects artist. Its creation has been an 11-year process, during which Delachaux worked with a geologist, biologist, volcanologist, and astrologist, to ensure that all details, elements, and configuration of the island are congruent with nature. Its design is a photorealistic blend of styles drawn from world-famous art exhibitions around the world. Moving through it, you'll feel as though you're attending the Venice Biennale, Art Basel, Soho, and Documenta, all in a single place. And the city is open to all visitors. There are no locked doors, pop-up events around every corner, and indoor and outdoor exhibits everywhere you look. But this is far more than just a metaverse. It's a comprehensive platform designed to give artists and galleries the tools they need to participate in the thriving NFT market. And through those tools, we aim to unite the world of fine art with the crypto world, creating a viable digital economy to support them in perpetuity. On top of all that, our project has Roger Haas as CEO, who is a prominent voice in the world of art, having founded a world-class gallery, in addition to leading a museum foundation in Switzerland. How Artists Can Participate in ArtMeta For artists, ArtMeta will serve as a valuable technical resource that helps them to bring their work to the digital domain. To accomplish that, we will provide artists with access to our full-featured NFT resources and teams. Had he known what implications Bitcoin would have on economies the world over through the course of the decade to come, he may have chosen to not barter 10,000 of his purse for just 2 pizzas. Namely because at the time of this writing in Q4 2021, said 10k BTC could retrieve a whopping $479 at the going rate: just shy of $48k each. Million Another event that seems to be an all-too-commonly told story, the old “I found a crypto wallet on an old device/ hard drive, but can’t seem to recall the seed-phrase mnemonic, password, and/or private key!” This is most commonly experienced by early adopters, cyberpunks of the time, who may have lost the recorded keys before crypto really took off to become so lucrative as a market and asset. Having the ability to recover wallets from close to a decade ago, could result in life-changing monetary value, which wasn’t the case when instantiated, therefore wasn’t seemingly as important to securely record mnemonics and private keys back then. That being said, provides segue and relativity to the topic. Seed Phrase Mnemonics, Private Keys, and YOUR MONEY! Are you like most new-to-crypto users, dipping your toes in the atmosphere by trading or investing on a centralized exchange (aka CEX) where your transactions are overseen, processed, and in the custody of the governing entity of each respective platform? The most likely instances I think of would be in the neighborhood of websites and apps including but not limited to: Coinbase, Coinbase Pro, Crypto.com, Kucoin, Voyager, Gemini, Phemex, Nexo, and so on. Decentralized exchanges (aka DEX) operate in a different manner, in that you would be prompted to connect your own wallet (which could be in the form of a hardware wallet like Trezor, or a software wallet like Metamask, Coinbase Wallet, and Trust Wallet) in order to transact with the exchange, make trades, and purchases. While each path has it’s own ratio of benefits: setbacks, there is one determining factor that means the difference in the control; or lack thereof over your assets. If you guessed KEY PAIRS, it seems you’re beginning to catch on! :) Key Pairs There is a common saying amongst members of crypto communities. When moving coins and tokens on a network or protocol, there are two main components in transacting securely: private keys and public keys. As depicted in the diagram at the top of this article (yes I drew it by hand just this morning), public keys (aka Wallet Address) are visible by within the block explorer once a transaction is completed and added to the current block of the chain’s ledger. “NOT YOUR KEYS, NOT YOUR WALLET!” ANYONE Private keys are to the contrary, as they should only be known by the two parties involved in each transaction. If your private key were to be mistakenly shared with an unintended party, it could result in the impeding party gaining ability to decrypt the message, access your wallet, or in this case, receive the coins or tokens that were intended for someone else. Or even remove the funds held by the compromised wallet. Each transaction has its own set of key pairs, however, your public key correlates with the wallet the transaction originated from, therefore if you were to create multiple transactions with the same wallet address, your public key would be publicly recorded to the ledger once for each transaction. This is why it’s usually best to create a new wallet for each transaction. While this may sound difficult, it’s actually really simple, and suggested by professionals to maintain utmost security, but also isn’t always necessary so long as your secrets remain as such. Metamask has one of the simplest and most modular GUIs out there, offered as a browser extension with a feature for simply creating new wallets w/ keys with a single click of the mouse and compatibility with almost every browser and crypto network out there in configuration. The main downfall I have personally witnessed with Metamask, it is possible for a hacker with ill intent to recover an account having the login username or email, and possibly brute-forcing a password attack by way of mnemonic seed phrase. This is not a very common occurrence, as an attacker would need to have your login details and means of verifying the account holds a number of coins or tokens worthy of the effort and risk, but it has happened. There is also an open bounty regarding a bug that affects seed phrase recovery of Metamask accounts on gitcoin.co right now, so there is a current effort from developers and pen. testers being directed to creating the most seamless functionality. Centralized Exchanges With a better understanding of how key pairs govern how transactions are made, we can look back at our centralized exchanges. Only to notice that, when you create an account or login to an account, there is no option of implementing a seed phrase for recovery in most cases. More importantly, when you make trades or transactions like sending coins or tokens to another person’s wallet, it is not required to provide a private key, and the public ones used, are created and provided by the exchange and out of your hands. What does this mean? It means that the exchange is the third party, central provider, governing entity, and has complete discretion over If the exchange were to experience technical difficulties, or even shut down completely in the worst-case scenario, you would be essentially S.O.L. This is why it is detrimental to utilize crypto wallets and exchanges that are non-custodial. For users of Coinbase and Coinbase Pro, the equivalent to the solution is as simple as using the to maintain custody and control of your assets and the key pairs that deem them as such. “your money". “Coinbase Wallet” If you were a user of Coinbase or Coinbase Pro less than a month ago, and you were a member of the demographic group of people that had invested in GYEN or POWR, then you saw first hand what it can look and feel like to have a custodial entity make implications in the state of your holdings without being able to have a say or any repercussions in the state of your trades or assets, as many members of this demographic found themselves either locked out of their accounts or unable to sell the very same assets they had previously purchased on the same platform. Caused by a mistake made by a developer, and none by the users, while the users suffered the consequences as a whole. I was a member of this group, and I am in no way bad-mouthing Coinbase. Just sharing my gained knowledge from the incident in hopes that the newcomers to the movement of crypto mass-adoption, in both private and retail environments, are able to differentiate their choices and know-how decisions in platform and protocol, can mean the difference in owning your assets or allowing others to own them for you. The key component in a custodial centralized exchange that proves attraction, is that they take transaction fees. This takes the place of high gas fees that are necessary to interact with any decentralized exchange that is operating as a second layer of ERC20, meaning it runs on Ethereum’s blockchain. So while you would be in control of your keys and assets when using a wallet like Metamask, transacting with other wallets or decentralized exchanges costs in gas, that can often be more than the initial amount of value in the sent or traded coins or tokens. With that in mind, I would advise any who inquired to choose a centralized exchange when dealing in small amounts of monetary value but use a wallet in which you are the implementer and controlling entity of key pairs when dealing with larger investments where it would be more economic to pay the gas fees in order to maintain discretion of your assets. For example, if you are simply investing $5 USD weekly or monthly, it may not be so lucrative at first to maintain your own keys, and certainly wouldn’t stand as economic to pay a gas fee of $20-$200 on each purchase/ trade. However, if you were making an investment in the thousands of dollars, the gas fee doesn’t amount to being higher than a fraction of the value you are securing, making it more sensible of a strategy. I hope this information helps everyone in a way that avoids the possibility of mistakes or being taken advantage of. Like any other economic market, there will always be scammers and someone trying to gain your confidence in order to take advantage. But the crypto community stands out from other markets in that many of its users are in it for the communal qualities, NFTs, implications for artists and creators; making charitable efforts that impact the real world, and paving the path of the largest social movement across the metaverse. Just shut up and give us your money before V 2.0 comes out. Fear, Uncertainty and Clout It was little known that we already domesticated some great names from the tradfi world. The big brains of investing knew that fresh money was coming so they welcomed them with open arms. If they did this to the stock market what could they do to our crypto bags? At first they didn't know what these newcomers want so they sat down and thought about it. Maybe a decentralized Twitter would sound great to them since they are censured on Reddit? That's what they are all pissed about, right? CLOUT Now that is a big word on Twitter. If you have that bluebird clout you are the voice of reason in the sea of stupidity. And our boy Chamath has a ton of it. Let's give these kids a home and let's name that home using the best buzzwords we can come up with. Since they like Bitcoin and want clout... You see where this is going... The trick is to cram as many of those buzzwords as you can in 160 characters. If you can also somehow make a case that it is the next Bitcoin that would be wonderful. As BitClout slowly started to fade into total irrelevancy the kids turned to their favorite YouTubers for something more simple and less technical. Of course Logan has something to suggest.
