Dish Network is fighting online streaming piracy on many fronts. Aside from lawsuits and other legal campaigns, the company also looks at the broader picture. In a new patent application, Dish envisions a blockchain-based anti-piracy management system that promises to be open and accessible to all. American satellite and broadcast provider has fought several legal battles against alleged pirate streaming tools in recent years. That became clear this week when we spotted a new patent application from Dish, which envisions a blockchain-based anti-piracy system. According to the company, piracy has become increasingly problematic. It’s not just limited to dedicated pirate sites but also plagues legitimate platforms such as YouTube and Facebook, it notes. “The distribution of infringed material on content sharing platforms such as Facebook and YouTube has grown rapidly,” Dish writes in its patent application. “For example, viewers can easily find links to live sporting events, hosted on someone’s Facebook account, find the newest episodes of their favorite series on YouTube or Dailymotion or even join groups like `mobile movies` on Telegram..,” the company adds. Dish writes that “millennials” and the “next generation” are increasingly turning their backs on the traditional bundle service system, opting for less-costly alternatives instead. These cheaper alternatives include the consumption of unlicensed content on legitimate services. While most large companies have their own anti-piracy solutions, these often have shortcomings, such as requiring rightsholders to actively search for pirated content. While a few large outfits use hash recognition to automatically detect content, those systems are often proprietary and not freely available. The new patent application envisions a technology that is supposed to be superior. While it can’t really be used to stop pirate sites, it proposes a blockchain-based anti-piracy system that legitimate services can use to check whether the content is published with permission, or not. “The inventors have conceived and reduced to practice a software and/or hardware facility that can be used by content owners to assert ownership of content so that copyright friendly websites and services can take action against copyright piracy effectively, efficiently and is scalable,” Dish writes. “The facility makes available to all content owners watermarking/fingerprinting technology so an identifier can be embedded in the content. The facility utilizes blockchain technology to add information related to each unique identifier in a database and allows an authorized user (e.g., the owner) to update the information through a blockchain transaction.” There are several practical implementations possible, but it’s clear that Dish is in favor of a widely available system that sites and services can use to determine whether content is authorized. The watermark or fingerprint-based system should interact with a blockchain to verify ownership details. Without a practical implementation, it’s hard to determine whether this approach will succeed or not. However, blockchain-based copyright management itself , as others have proposed this as well. The same is true for watermarking and fingerprinting. is not a new idea It’s interesting to see that Dish is actively pursuing an alternative anti-piracy approach. Time will tell if it comes to fruition, and if so, how effective it will be. One thing’s almost guaranteed though, there will be plenty of attempts by pirates to get around it. Blockbuster Efforts It would take some brilliant minds to make that name relevant again and I doubt it would even be worth it. The whole renting movies in-store and taking them home model is obsolete today. It was becoming obsolete with the subscription model being popularised. The simple fact is that the service Blockbuster provided became useless, and the only way they would have been able to survive is changing their entire structure to match their rival's. It is not surprising that restructuring an entire business is difficult to do. They needed to break into that video on demand and video by mail industry and as we saw they gave it a try: 1. They tried it with Enron Direct TV and started providing their own services. 2. We see this by the fact that they continued to open more stores while they were experimenting with other services and seeing what would catch on and be profitable. They predicted that it was the way of the future. But it seems they underestimated how quickly the future came, they didn’t feel the urgency to do it early on, and once they did it was too late. What Blockbuster Provided I’m sure if I pulled you aside 35 years ago and asked you if you thought that video rental stores would be completely irrelevant in 5–10 years you would have said of course not, and that’s what Blockbuster thought. But let’s remember exactly what Blockbuster provided: Netflix provides movies but Blockbuster also provided a whole experience, and that’s something you don’t get from Netflix. I think of it as being like a movie theatre when you pay the $10 for the ticket you’re not just paying for the movie you’re paying for the whole experience. Blockbuster is a victim of the world changing around them. If they were able to tell the future they probably could have started restructuring their business model early enough to have an edge on Netflix. But we can’t fault them for not knowing the future in the early 2000s. They were in a time where they needed to make changes fast but they weren’t aware of it. The sad truth is some companies aren’t meant to last forever. Conclusion Maybe it was just time for Blockbuster to fade into the sunset. I don’t like thinking of them as the joke that they’ve become, I prefer to remember them during a time when things were different and when life was simpler.

The Fall of a Video Rental Empire: How Blockbuster Grew too Big to Change

A lawsuit filed by US broadcaster DISH Network against Easybox IPTV looks set to end with significant cost to the men behind the unlicensed IPTV provider. In a motion for final judgment and permanent injunction, DISH is demanding $9.9m in damages for direct copyright infringement of 66 copyrighted works, broadcast by Easybox without permission. There are thousands of businesses and individuals involved in the supply and sale of ‘pirate’ IPTV services around the globe. These subscription packages routinely grant access to hundreds and even thousands of otherwise premium channels for a cheap price, undermining the business models of content providers and broadcasters alike. This has resulted in both criminal and civil action across several continents with broadcaster DISH Network leading the charge in the US. Just one of the company’s lawsuits, last August in a Texas court, targeted Easybox, an IPTV service that reportedly offered subscribers more than 1,000 channels, including more than two dozen channels exclusively licensed by DISH. filed “Defendants capture live broadcast signals of the Protected Channels, transcode these signals into a format useful for streaming over the Internet, transfer the transcoded content to one or more servers provided, controlled, and maintained by Defendants, and then transmit the Protected Channels to Service Users through OTT delivery,” the DISH complaint alleged. According to DISH, the company went to great lengths to have Easybox cease its activities in advance of filing the lawsuit, including sending almost 300 copyright infringement notices to the service and its CDN providers, all of which were ignored. The Easybox IPTV offering Last September, DISH was permission to subpoena several companies (including PayPal, Google and Namecheap) in order to identify the people behind Easybox. They were eventually named as Hung Tran and Thi Nga Nguyen. granted With the individuals mounting no defense, DISH requested a default judgment at the end of December 2019 with a clerk entering a default earlier this month. DISH has now laid out its proposals for a final judgment and permanent injunction. “Defendants, without authorization from DISH, transmitted the Protected Channels and the copyrighted works that air on those channels to users of their Easybox set-top boxes, smart IPTV subscriptions, and subscription renewals in the United States. In doing so, Defendants directly infringed DISH’s exclusive rights to distribute and publicly perform the works that air on the Protected Channels,” the proposed order reads. Laying out its claim for direct copyright infringement, DISH demands statutory damages of $150,000 for each of 66 registered and copyrighted works owned by DISH and that the defendants “willfully and maliciously infringed by transmitting without authorization on the Easybox service.” That’s a not-insignificant total of $9.9m. In addition, DISH is demanding a permanent injunction to prevent the defendants or anyone acting in concert with them from streaming, distributing, or publicly performing DISH channels and programming, and/or advertising, selling or providing any service offering the same. DISH is also requesting an order preventing any company from providing infrastructure to the defendants in respect of Easybox or a similar service. These include data centers, domain companies, domain anonymization services, CDNs, and social media platforms. The broadcaster further demands that Verisign and any other registries or registrars of the domains Easybox.tv, E900x.com, and k2442.com should render them inaccessible before transferring them to DISH for the company’s use. Any future domains registered by the defendants for the purposes of infringing DISH’s rights should be treated similarly, the proposed injunction reads. The court is yet to sign off on DISH’s proposals but given the one-way traffic thus far in what has become a busy case generating thousands of pages of documents, a judgment favorable to Easybox seems unlikely. A judge at a Texas court has ordered two individuals behind the pirate IPTV service Easybox IPTV to pay $9.9m in copyright infringement damages. In a judgment handed down this week, the judge awarded the maximum $150,000 in statutory damages for each of 66 copyrighted works willfully infringed by the defendants via their unlicensed streaming platform. As part of its ongoing campaign targeting unlicensed IPTV providers servicing the US market, broadcaster DISH Network filed a lawsuit in a Texas court last August. It Easybox, an IPTV service that reportedly offered subscribers more than 1,000 channels, including more than two dozen channels exclusively licensed by DISH. targeted The broadcaster’s lawsuits often target IPTV providers for alleged breaches of the Federal Communications Act but in this instance, the lawsuit was based in copyright law. In common with other similar actions currently winding their way through US courts, this one met little opposition along the way. DISH says it tried to get Easybox to stop its illegal activities on many occasions before filing the lawsuit, including by sending around 300 copyright infringement notices to the provider and its CDN providers between 2016 and 2019. All were ignored so the broadcaster was left with little option but to bring the matter before a judge. As last week, DISH recently put forward a proposed final judgment and permanent injunction for the court’s consideration. That has now been largely accepted and signed off by the court, with some exceptions, but largely along the lines of DISH’s recommendations. reported in detail In an order signed February 5 by District Court Judge Lynn N. Hughes, the Judge notes that defendants Hung Tran and Thi Nga Nguyen were served on November 21, 2019, but neither filed an answer or otherwise appeared to defend the action. As a result, the order grants DISH $150,000 in statutory damages for 66 of DISH’s copyrighted works infringed via the IPTV service. “Dish Network LLC will take $9,900,000 from Hung Tran, Thi Nga Nguyen, and Easybox IPTV, jointly and severally, plus interest,” the default judgment reads. “This amount reflects statutory damages of $150,000 for their willful infringement of sixty-six of Dish’s copyrighted works.” The terms of the permanent junction are less tightly-worded than those proposed by DISH but still restrain the defendants, Easybox IPTV, or any entity they create, from distributing DISH’s channels in the United States or selling Easybox set-top boxes or IPTV subscriptions that stream DISH’s channels. The injunction also orders various service providers to stop doing business with Easybox and the named defendants, if that business entails transmitting copyrighted TV shows. Those third-party Internet companies are named as Global Layer B.V. and WorldStream B.V. (Netherlands), OVH Hosting Inc. (Canada), and Netrouting Inc. (United States). In its proposed permanent injunction, DISH previously requested that the registries in control of domain names connected to Easybox should render them inaccessible before transferring them to DISH for the company’s use. The actual injunction handed down by Judge Hughes doesn’t go quite that far. “Registries must disable the domain names used to transmit Dish’s protected channels within forty-eight hours of receiving this order. The domain names to be disabled include easybox.tv, e900x.com, and k2442.com, and any future domain name used by Easybox IPTV, Hung Tran, or Thi Nga Nguyen to transmit Dish’s channels.” Whether the defendants will pay all or indeed any of the damages handed down by the Court remains an open question. It’s running out of time One could argue that “time is money” and that is true, but startup businesses more frequently run out of time than money. In today’s cash-flush and credit-rich society, coming up with extra coin—especially for a promising startup—is easier than coming up with a few extra months of runway to get a product released or a customer order fulfilled. No, the greatest enemy to any fledgling startup is running out of time to deliver. As some of the most successful digital startups have shown, if you are hitting milestones, onboarding new customers and bringing in some semblance of revenue (with a clear path toward profits), the money can be procured. Unfortunately, you can’t simply raise more capital and then buy yourself extra months of runway. It simply doesn’t work that way. An SEO-only strategy, especially for inbound marketing, would simply take too long. And time is not something most startups have. This is where blue ocean innovators truly have the upper hand. When demand can be created by waging a war of attrition on your own terms, you don’t need to fight for ground that is already hotly contested by would-be competitors. While you may compete in online search for similar keywords, a truly innovative company can stay above the fray, taking more of a PR angle, than one steeped in shady manual link building tactics. Believe me, in this regard. there are no strategy shortages A Greater Focus on Revenue Instead of focusing on marketing, new(er) businesses that have a working product to sell should instead focus on sales. This outbound over inbound approach will create the quick wins needed to take the business out of early-stage territory. When I founded my first startup, we did not have an innovative product, but we did have salesmanship and that is what we used. The business: a Dish Network retailer, selling and installing satellite dishes for local television service in the Seattle area. I was 22. We housed the hundreds of dishes and satellite receivers out of my parents’ garage and sold satellites door-to-door while we worked to finish college. We had no website. Only a business license and a bunch of equipment we had purchased on credit. From the outset, we immediately hired some 20+ contract salespeople to help push the product to our target customer: watchers of TV. It worked. In the first year, we had acquired over 1,000 customers and reached over $1M in sales. If we had relied on inbound traffic from a search engine, we would have never made a single sale—not a one. But, by focusing our efforts on things we could immediately control, we were—in my estimation for a first-time startup—greatly successful. A similar focus on outbound instead of inbound can help shelter any business against the ups and downs inherent in ranking changes in online search. Any business—startup or otherwise—that bases their entire sales strategy on Google search traffic and an inbound approach is more likely to see revenue move in delayed lockstep to traffic peaks and troughs. The better plan is to create an internal sales system that insulates the business against the wiles of search gods.
