I've spent enough time watching this play out across industries – biotech, semiconductors, payments, and now blockchain – to be confident about one thing: the companies that treat compliance as a tax will always lose to the companies that treat it as engineering. The Friction Myth The Friction Myth There's a persistent belief in startup culture that compliance slows you down. That every regulatory requirement is a speed bump, every licensing framework a bureaucratic wall. I understand where it comes from. Early-stage founders are moving fast, capital is constrained, and legal counsel is expensive. But this is a category error. Friction and structure are not the same thing. Friction is what you get when compliance is bolted on after the fact – when a legal team is handed a product that's already been built and asked to reverse-engineer conformance into it. That's genuinely slow, genuinely expensive, and genuinely painful. That version of compliance deserves its bad reputation. That capability doesn't accumulate gradually. It compounds. And it compounds in a way that is genuinely difficult to replicate once you're behind. This is not a theoretical point. The businesses that have scaled fastest in fintech, and the ones that are scaling fastest in crypto infrastructure right now, are not the ones that shipped product before dealing with regulation. At the product layer: how does your product interact with regulated assets, regulated entities, and regulated markets? MiCA isn't primarily a legal constraint for European crypto operators. They're scaling into a market where several exchanges have already begun restricting or reviewing support for non-MiCA-compliant stablecoins as the regulation approached full enforcement – while less-prepared operators scramble to adapt. MiCA At the go-to-market layer: how do you talk about your product to regulated institutions, to regulators themselves, to partners in jurisdictions with different risk appetites? The ability to articulate your compliance posture clearly and credibly is a sales capability. It is the difference between a 90-day procurement cycle and a 9-month one. The Selection Mechanism The Selection Mechanism Here is what is actually happening in crypto infrastructure right now, and it's worth being direct about it. MiCA is not a headwind for operators who did the work. It's a selection mechanism. Hundreds of millions of euros in penalties have already been issued across EU jurisdictions enforcing MiCA, and dozens of crypto firms have lost licenses or been forced to exit European markets as regulators began applying MiCA-aligned requirements in earnest.
