One of the reasons for this is because the government has actually restricted shops to only accept Bolivares. (Update 7–11–18: According to other sources, the gov’t doesn’t restrict payment options to just Bolivares.) Meet Pedro Perez Pedro is a Venezuelan who I had the privilege of interviewing over the internet. Pedro isn’t actually his real name. It is the Venezuelan equivalent to John Doe. He has chosen to remain anonymous because he is scared that the Venezuelan gov’t will be to identify his voice, find him, and then put him in jail. The following is a summarized translation of the interview I had with Pedro, which you can find here: Pedro, tell me. How bad is it exactly in Venezuela? The minimum salary is 2.5 millions of Bolivares. A kilogram of meat costs 4.5 million Bolivares, a pound of rice and a pound of chicken costs 1.3 million Bolivares. For you to have as a reference, let’s suppose you work in the U.S. 8 hours per day from Monday until Friday with a pay of $8 dollars per hour. This will give you a total of about 1,300$ dollars per month and then you go to the grocery store and you see a kilogram of meat is $2,500 dollars. Do you see? Of course, part of the economy is coherent with the low salaries, but these keep getting lower every time. The only things that are proportional with the salaries are the public services like electricity, water phone line, gas, fuel, public transportation and internet. That and nothing else. Not to mention you are also exposed to the insecurities, shortages and problems in hospitals and clinics. Venezuela is now today the most unsafe country in Latin America How much is it to buy a cup of coffee? How much was it a year ago? A cup of coffee with milk in January was 30,000 Bolivares and two weeks later it was at 50,000 Bolivares. In February it went up to 70,000 Bolivares. In March, I think the price was 100,000 Bolivares. That price was steady until April where it went up to 250,000 Bolivares. It is still at that price but I don’t know for how much longer. How is cryptocurrency viewed in Venezuela? Since a few years, there has been a lot of people making a lot of money mining here in Venezuela. The electricity is of bad quality but is basically free so it makes mining very profitable. The people who started mining are usually of high class and were capable of buying Antminers or GPUs. As time passed a lot of people have read about this subject, especially younger people. Fortunately, the internet is not censored except for 2 or 3 websites. And it’s also very affordable which makes global news accessible just anywhere in the world. And just like it happens everywhere in the world, not a lot of people understand the subject in general (my parents are one of them). At the end of last year, Maduro announced the Petro coin. The first cryptocurrency created by the government. This made a lot of people do some research and educate themselves on the subject. The propaganda put out by the government says that with only the Petro coin the country will recover. This is said without even providing any further details and fanatics repeat this over and over again without understanding the real concept of cryptocurrency. That is crazy to me. I first read that Petro was supposed to be an ERC20 token which Maduro said would be “ .” Then they decided to as the underlying blockchain. It doesn’t sound to me like they know exactly what they’re talking about. This could be one of the worst ICO scams to date. A central govornment, privately fundraising an ICO, with just a white paper, and their project isn’t open-source. mined switch to NEM Yes. Them switching between ETH and NEM completely removes any confidence in the Petro coin. However to be clear, Petro will be a NEM token created by the government. In my opinion, the main goal is to skip the penalties the United States and the European Union has taxed on the agencies and government officials. And I would say this, today is not possible to buy Petros with Bolivares. And legally, Venezuelans only have access to Bolivares. Speaking of which, what are the “on” and “off” ramps to cryptocurrency there? The way to obtain crypto is by mining, accepting payments in crypto (which a lot of young people who speak english and who are graphic designers, translators, programmers and work remotely do). Another way is to simply buy it in Localbitcoin with Bolivares. In LocalBitcoin you can do both, buy and/or sell. Another way is to receive money via PayPal, Payza, Netteller or Uphold and transfer it to AirTM and then exchange it to Bolivares. By the way the AirTM website is blocked in Venezuela by DNS. This is one of the objectives of the operation called “Manos de Papel” which translates to “Paper Hands”. Is cryptocurrency replacing fiat in Venezuela for day to day purchases? Unfortunately, not yet. In fact, if you have a lot of cryptocurrency or dollars, you have to look for a way to exchange them to Bolivares because by law, stores and businesses can only accept Bolivares. (edit 7/11/18: According to other sources, businesses can accept cryptocurrency). This has become a problem because, for example, 1 LTC is 126,000,000 Bolivares which is about 60 months worth the salary of a worker. So the government with the help of banks (including private banks) started to “analyze” the movements between accounts just to see who is buying and/or selling dollars and/or crypto. There are two types of exchange methods in Venezuela. One is out on the streets called Negro or Paralelo (which is illegal). This one is going currently for 900,000 Bolivares per dollar and it’s based on supply and demand. The other way is auction established and controlled by the government called “DICOM” and it goes for 70,000 Bolivares per dollar. The difference is almost 13 times. Even using the exchange rate of the government, the minimal salary would be 36.42 Dollars and that’s extremely low! Basically, if one of my family members sends me 100 dollars, by the government’s exchange rate I would only get 7,000,000 Bolivares. This means I could only buy less than 2kg of meat. If that same amount of money (100 dollar) is exchanged in the black market, I would get about 90,000,000 Bolivares and would be able to buy 20 kg of meat. This is now coherent to international prices. So the government wants to buy the dollar at 70,000 Bolivares per dollar but don’t want to sell it for this rate (the offer is limited). This gives it a reason for the black market to exist. A serious government could eliminate that DICOM and legalize the black market’s rate. This would make the exchange rate be more stabilized. Some economists have actually said that at 200,000 Bolivares per dollar would make the exchange rate coherent. I’ve heard reports that the Bolivar is now being measured by Bitcoin instead of the US dollar. I don’t think that is true. The people who know and work with crypto must exchange to USD and then to crypto. DolarToday is a website that shows the blackmarket value of Bolivares to USD. It is run by several people who are presumably out of reach of the Venezuelan gov’t. But some people suspect that it was compromised around Dec 2017 because there was a divergence between DolarToday and other blackmarket exchanges like AirTM. There’s been some discussion that the government took over the DolarToday website. Is this true? Until a few months ago, a lot of people would use as a reference DolarToday.com. This is now a blocked website by DNS here in Venezuela. For several months the price was 20,000 Bolivares per dollar all while the prices of products and services kept going up. In January when someone sent a family member in Venezuela 40 Dollars monthly, that would be enough but in March, those 40 dollars were now a different value because DolarToday would still show the rate to 200,000 Bolivares. This made people fix it to the price they wanted, higher than the one stated on DolarToday. DolarToday was 200,000 Bolivares and people were selling for 300,000 Bolivares. Exactly today, DolarToday is at 710,000 Bolivares and people here are are selling for 900,000 Bolivares. A lot of people say this happened because the government took control over DolarToday. I don’t believe it. They only publish the the exchange rate based on the rate in Cucuta (Cucuta is a city in Colombia) where the exchange of Colombian pesos, dollars and Bolivares is done in a free manner based on supply and demand. A Ponzi scheme is an investment fraud where a fraudster collects money from people with a promise of higher than the usual market rate returns. A Ponzi scheme involves circulation of the capital instead of the distribution of profits. Such go belly up because there is no profit-making involved. schemes The principal investment by subsequent investors is given as a payout to the old investors. This type of investment is not sustainable because for it to continue to operate, there has to be a constant stream of new investors. Scheme operators often end up using cash reserves to give payouts to existing investors when they don’t find new investors. A Ponzi scheme is an investment fraud because the operators of such schemes don’t actually intend to invest their investors’ money in any legitimate investment option or give long-term payouts to their investors. A Brief History of the Ponzi Scheme: The Ponzi scheme gets its name from , an Italian swindler, who was arrested in August 1920 for several counts of fraud. Ponzi promised investors a 100% return on their investment in 90 days. He convinced people that there was money to be made by taking advantage of fluctuating currency rates post World War I. Charles Ponzi Ponzi convinced people that he would buy postal-reply coupons at a discounted rate in a foreign country and then sell them at face value in the U.S., thereby earning great profits. Postal-reply coupons were coupons that were sent along with a letter from a foreign country, which would enable the recipient of the home country to write back to the sender without having to buy foreign postage stamps. Postal-reply coupons could be exchanged for a foreign stamp without any monetary transaction. This was done to ensure that the person who had to reply to the letter didn’t have to worry about currency exchange rates while buying postage stamps. They simply had to exchange coupons for stamps. The scheme lasted for over a year before falling apart in 1920. His investors lost about  $20 million when an article in the exposed Ponzi and his criminal activities. Charles Ponzi received a 5 years prison sentence for mail fraud in 1920. Post There were several people before Ponzi, like Sarah Howe, William Miller, etc., and several others after him like Ivar Kreuger, Bernard Madoff, etc., who masterminded these schemes that swindled millions of dollars from unsuspecting investors. Ponzi Scheme Vs. Pyramid Scheme: Although a Ponzi scheme is very similar to a Pyramid scheme, the key difference between the two schemes is that in a Pyramid scheme, the existing investors are actively involved in recruiting new investors. In a Ponzi scheme, however, there is no direct participation of old investors in recruiting new investors. In a Ponzi scheme, all transactions are handled by scheme operators. In essence, a Ponzi scheme is an investment fraud and a Pyramid scheme is disguised as a Multi-Level Marketing (MLM) business. Another difference between a Ponzi scheme and a Pyramid scheme is that there is no specific product or service in a Ponzi scheme. However, in a Pyramid scheme, the scheme operators offer either a single product or service or a set of products and services from which they claim to make tremendous profits. The operators lure more and more people with a promise of a profit. However, if the scheme fails to attract new investors, it falls apart leading to people losing all the money they invested. Red Flags to Watch Out For: Here are red flags investors should watch out for: Problematic paperwork: In a Ponzi scheme, the investors aren’t usually given access to any investment-related documentation. Be it prospectus or account statements, investors are usually unaware of what happens to their money or where the operators have invested it. Operators keep investors in the dark about all investment-related decisions. Not registered: Ponzi scheme operators often claim that their investment plan is exempt from registration. An operator who claims that their investment plan doesn’t need to be registered with the Securities and Exchange Commission (SEC) or other regulators should not be trusted. Pressure tactics: Most of the Ponzi scheme operators can be charismatic charlatans who can convince investors that their scheme is a limited-entry offer reserved only for a select few. They use pressure tactics to convince investors to make up their minds sooner rather than later. Operators usually convince investors that if they make a late decision, then they’ll lose out on the opportunity to make tons of money. This fear often leads people to make uninformed decisions. No risk, high returns: There is always some risk associated with investing. Any investment plan that claims otherwise should not be trusted. Also, it’s practically impossible for investors to gain above-average returns without having to bear any risk. Consistent returns: All investment plans are subject to market risk. If a scheme offers payout or dividend consistently irrespective of market fluctuations, then such a scheme is not sustainable and will fall apart sooner or later. Unclear organizational structure: Most Ponzi schemes don’t have a proper organizational structure. Investors should thoroughly research and enquire about the people operating the scheme and their backgrounds. is a big prospective learning method for the same. They should insist on talking to the board of directors or anyone who is a key member of the board and ask them questions about the investment plan before investing. Observational Learning Steps to Take to Avoid Falling Prey to a Ponzi Scheme: Investors should be extra cautious before trusting someone with their hard-earned money. To avoid walking into a trap, prospective investors should: Not cave in: It’s never wise to fall for pressure tactics. It’s always important to take enough and more time before making any financial decision. Ask questions: It’s important to ask the right questions to people in authority about where they plan to invest their investors’ money. People should ask questions about registration, documentation, and everything else that is necessary to make an investment legitimate. Look for reviews online: With the dawn of the Internet, it’s easier to differentiate a legitimate investment from an illegitimate one. Prospective investors can research an investment scheme on the Internet to check what others are saying about that scheme. If there are more negative reviews than positive, then it makes sense to stay away from such schemes. Consult a financial advisor: It helps to take a second opinion from a financial advisor. Financial advisors have the expertise required to offer appropriate guidance. They also have access to industry inside information which equips them with the necessary knowledge to help investors make a decision. Exercise caution: This can’t be emphasized enough. It’s better to be safe than sorry, always. Investors should exercise caution and not fall for marketing gimmicks. It’s always better to reach out to experts before investing. With the dawn of the Internet, it’s now easier to reach more people to pitch a scheme to. The bank, wanting to keep the client happy, issues a temporary $1,000 provisional credit. The scammer will then call the victim, telling them that they accidentally deposited twice the amount of money. The scammer instructs the victim to send them $500 dollars through Zelle, which the victim does. Later on, the bank retracts the provisional credit, leaving the victim down $500. Never give out your banking information to anyone you don’t know. How to avoid this scam: Also, in general, don’t send money through Zelle to anyone you don’t know. 5. Swipe Left: The Dating Scam When looking for love, make sure the other person’s not looking for your money. A victim lands on a fake dating profile and gets catfished by a scammer to send them money through Zelle. How it works: By the time the victim understands what’s going on, it’s too late. This was a question we received from a lead, and it was so detailed I wondered how it could reply. Q: Hey there! I was wondering if you could give me a rough pricing estimate. Our used case: – 42 agents – Product tours – Chat Bot – Help Centre with 200+ articles for users & visitors – People reached per month: 11k+ I would need a rough ballpark for comparison without big sales call please ;)” It selected the right Enterprise plan, but it didn’t calculate the additional cost per the exceeding 27 agents; it just shared the cost of $249 with the included agents. Good, but definitely not the right answer. CSAT ⭐️⭐️☆☆☆ #7 Question: Onboarding Question The user wanted to share a link with their customers to chat. Dutch anti-piracy group BREIN says it has shut down a music piracy service that offered an illegal pool of 350,000 tracks in exchange for an annual payment of 250 euros. That matter has now ended in a cash settlement but five years ago, a man who provided a similar service in the UK with a not-for-profit motive, was jailed for a year. Dutch anti-piracy group BREIN is at the forefront of the battle against unlicensed services in the Netherlands. In the last year alone, BREIN conducted 479 investigations which resulted in the and services, including torrent and streaming sites, IPTV providers, and platforms that distribute music without an appropriate license. shutdown of 466 illegal sites While BREIN has been hinting at criminal prosecutions for a while, the anti-piracy group tends to focus on civil actions. BREIN certainly doesn’t shy away from taking matters to court but whenever it can, settlements and an agreement to cease and desist can be enough to ward off more serious action. BREIN Targets a 350,000 Track DJ Record Pool Service Late last week, BREIN revealed an investigation into the operator of an online service that provided access to an illegal DJ record pool. Providing such a service requires extensive licensing from authors and neighbouring rightsholders but according to BREIN, the man had not obtained the necessary permission. The service was fairly comprehensive. BREIN estimates that the platform offered around 350,000 tracks for download but, unlike a regular pirate site, users were charged a subscription of 250 euros per year. This made it a for-profit enterprise not dissimilar to those offered by illicit IPTV providers, for example. Operation Shut Down, Settlement Reached It is unclear whether the DJ service met the threshold for criminal enforcement measures in the Netherlands but the for-profit distribution of copyrighted content certainly raises that prospect. In the event, however, BREIN decided to tackle the matter on its own and as a result, evidence and hardware (including digital storage devices) were seized from the operator’s home. Ultimately, BREIN agreed to settle its differences with the operator outside court. “After consultation with his lawyer, the man chose to settle the case by means of a settlement,” BREIN reports. “He has signed a declaration of abstention with a penalty clause in the event of future infringements of 2,500 euros per day (or part thereof) with a maximum of 50,000 euros. He also allowed access to the seized digital documents. Finally, he paid 20,000 euros in final discharge.” While the penalties for non-compliance are harsh and the 20,000 euros settlement not insignificant, had this taken place elsewhere in Europe a few years ago, the outcome could have been very different. DJ in the UK Jailed for Operating a Similar Resource Back in 2015, Liverpool DJ Wayne Evans (known online as OldSkoolScouse) was by the Police Intellectual Property Crime Unit following an investigation carried out by licensing outfit PRS for Music. raided Evans had uploaded music to torrent sites such as The Pirate Bay and KickassTorrents but also ran DeeJayPortal, a download site specializing in A capella versions of music tracks. “We’re committed to partnering with PIPCU to enforce against illegal services that are not willing to work with us towards a legitimate licensed model, and which continue to exploit our members’ work without permission,” PRS said at the time. After entering a guilty plea in October 2016, Evans was later sentenced on two counts of distributing an article infringing copyright and one of possessing or controlling an article for use in fraud. Fraud typically carries a harsher sentence in the UK and prosecutions under this legislation are now favoured by copyright holders. Police originally claimed that Evans was making considerable amounts of money from his enterprise but at his sentencing, Judge Robert Trevor-Jones accepted that Evans hadn’t been motivated by personal gain. This stands in contrast to the BREIN matter where profit was clearly the driver. Nevertheless, Evans was sentenced to 12 months in prison, despite having no previous convictions. Outcomes Depend on the Mood of Rightsholders While the alleged scale of offending certainly plays a key part, the outcomes in these two cases raise interesting questions. BREIN was obviously keen to shut the unlicensed DJ service down, something it achieved without police involvement while also winning a settlement. The news of the outcome also sends a deterrent message since few people have 20,000 euros kicking around to pay off rightsholders. PRS, on the other hand, clearly wanted to send a more forceful deterrent message so instead of a cease-and-desist, took the decision to go for the jugular, resulting in the closure of the service but also a prison sentence for Evans. It’s unclear what BREIN would’ve done had his offending have been in the Netherlands but cases thus far suggest that particular outcome would’ve been unlikely. Evans, it appears, was doing the wrong thing at the wrong time in the wrong place with the wrong adversary. Had he been elsewhere in Europe at the time, things may have gone quite differently. The overriding message is that in the current environment, operating piracy services in the UK has a greater chance of attracting the attention of the police than ever before. And when rightsholders want to send a public message of deterrence, outcomes can be serious. Previously published here.
